A Division Bench (DB) of State High Court involving Chief Justice Gita Mittal and Justice Rashid Ali Dar on Friday guided State to document a status report with respect to plausibility of making a devoted specialist for the welfare of transgenders.

The court coordinated to put the aforementioned status report before the Chief Secretary of the State for thought and furthermore coordinated to give a duplicate of its request dated July 19, 2019 and the present request to the workplace of the Chief Secretary to guarantee consistence before the following date.

While considering the status report recorded by Feroz Ahmad Sheik, Dy. AG, dated June 29, 2019 for the benefit of the Social Welfare Department and different offices, the DB saw that the report, in any case, is pitifully inadequate and just reveals directions and correspondences entomb se the divisions. For example, we are not educated with regards to the means taken to guarantee school and school admissions to the transgender network.

DB further guided the State Government to put under the watchful eye of this Court a status report which should set out bearings and directions as well as the means really taken and the situation on the ground with respect to guaranteeing and empowering a comprehensive domain to the transgenders in the State.

The status report in such manner will be documented before the following date of hearing, the court held. It was brought up by Moksha Kazmi, Amicus Curiae that in a few different States, the State Governments have established Transgender Welfare Boards. "There is no such Board or Authority in the State of J&K. It is significant if such a Board is made here which would be an appreciated advance for J&K and would go far in alleviating the sufferings and troubles of the transgender network", she submitted.

Upon this, the DB guided Chief Secretary of the State to inspect this part of the issue and, if conceivable, assign/establish a committed expert for the welfare of transgenders. Such expert would work as a nodal specialist and will go far in moderating the misfortunes of the transgenders, the court watched.
